Data Processing Agreement

(“Processor”, “we”, “us”, or “our”)

and

You, the user of the AI Rank Checker Service
(“Controller”, “you”, or “your”)

This Data Processing Agreement supplements the Terms of Service and governs the processing of personal data by AI Rank Checker Inc. on behalf of the user.

1. Definitions

  • Personal Data: Any information relating to an identified or identifiable natural person.

  • Processing: Any operation performed on personal data (e.g., collection, storage, access).

  • Data Controller: The party that determines the purpose and means of data processing (You).

  • Data Processor: The party that processes data on behalf of the controller (AI Rank Checker Inc.).

  • Sub-processor: Any third party engaged by the Processor to help process personal data.

2. Subject Matter

This DPA applies to the processing of personal data as required for the use of the AI Rank Checker platform, including account setup, service delivery, support, analytics, and performance tracking.

3. Roles and Scope

  • You are the Data Controller.

  • AI Rank Checker Inc. is the Data Processor.

  • We process your personal data solely on your documented instructions, unless legally required to do otherwise.

4. Types of Data Processed

We may process:

  • User-provided data: Name, email address, login credentials, billing details

  • Content data: Keywords, domains, tracked content

  • Technical data: IP address, browser info, usage logs, cookies

We do not process sensitive personal data (e.g., health, religion, biometric data).

5. Purpose of Processing

We process data solely to:

  • Provide, improve, and maintain the AI Rank Checker service

  • Support your account

  • Comply with legal and contractual obligations

6. Sub-processors

We use third-party service providers to assist with processing. These may include:

  • Hosting providers (e.g., AWS, Vercel)

  • Analytics tools (e.g., Plausible, PostHog)

  • Payment processors (e.g., Stripe)

All sub-processors are bound by confidentiality and data protection obligations equivalent to this DPA.

7. Security Measures

We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including:

  • Encrypted data transfer (SSL/TLS)

  • Access controls and authentication

  • Secure data storage

  • Staff access restrictions and confidentiality

8. International Transfers

If personal data is transferred outside the EEA or another jurisdiction with equivalent data protection laws, we ensure such transfers are lawful (e.g., using Standard Contractual Clauses or adequacy decisions).

9. Data Subject Rights

We will assist you in responding to data subjects exercising their rights under applicable law, including:

  • Access, correction, and deletion of personal data

  • Data portability

  • Objection to processing

10. Data Retention and Deletion

We retain personal data only as long as necessary to provide the Service or as required by law.
Upon termination or written request, we will delete or return all personal data unless retention is legally required.

11. Audits

You may request reasonable evidence of our compliance with this DPA. We may fulfill this obligation by providing documentation or third-party audit summaries. Formal audits are subject to scheduling, cost, and confidentiality requirements.

12. Limitation of Liability

This DPA is subject to the limitations of liability stated in our Terms of Service.

13. Governing Law

This DPA is governed by the laws of the State of Delaware, USA, unless otherwise required by applicable data protection laws.
